Terms of sale

Purpose
These General Terms and Conditions of Sale (GTC) govern the sale of products offered on the website www.crackinthewall.com by the company MAKALU SAS (hereinafter referred to as "the Seller") to any customer (hereinafter referred to as "the Customer"), whether individual or professional.

Products
The Seller offers a wide range of products related to climbing, outdoor activities, and fashion: harnesses, clothing, climbing shoes, technical accessories, stickers, care products, etc. The essential characteristics of each product are described on its respective product page.

Pre-orders
Some products may be offered as pre-orders, particularly the climbing harness. Full payment is required at the time of the order. An estimated delivery date is indicated on the product page. A reasonable delay may occur without automatically cancelling the order. The Customer will be informed of any significant change. If the delay exceeds 30 days beyond the estimated date, the Customer will be informed of the new timeframe. If this new delay exceeds 30 days, the Customer may cancel the order and request a full refund in accordance with the law.

Prices
Prices are listed in euros, all taxes included (VAT). Shipping fees are specified before the order is confirmed. The Seller reserves the right to change prices at any time, but products will be invoiced based on the rates in effect at the time of order confirmation. Orders must be paid online using Shopify’s secure payment tools (credit cards, etc.) and are due upon confirmation.

Orders
Any order implies acceptance of these GTC. Once payment is confirmed, the Customer receives an email summarizing the order.

Delivery
By default, deliveries are made within the European Union. Some products, such as apparel or accessories not requiring specific certification, may be delivered to other geographic areas. The delivery terms and fees are detailed in the Shipping Policy. If shipping is not available to the Customer’s location, they will be notified prior to finalizing the order. Delivery times vary depending on the destination and shipping method chosen and are indicated during the checkout process or in the Shipping Policy: 48–72h for mainland France, 3–5 business days for the EU.

Right of Withdrawal
In accordance with European law, the Customer has a 14-day period from the receipt of the product (excluding customized or sealed items that cannot be returned for hygiene or health protection reasons) to exercise their right of withdrawal. For pre-orders, this period begins at delivery. Return shipping costs are at the Customer’s expense. To exercise this right, the Customer must notify their decision by email (contact@crackinthewall.fr) and return the product in its original, unused condition to the following address: 3 bis rue Rosa Bonheur, 75015 Paris, France.

Warranties
Products are covered by the legal warranty of conformity (Articles L217-4 et seq. of the French Consumer Code) and warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). In case of non-conformity or defect, the Customer is invited to contact customer service for a quick resolution (exchange, repair, refund). In accordance with the law, the Customer benefits from a 2-year legal warranty of conformity from the date of delivery.

Personal Data
Personal data is collected and processed in accordance with the General Data Protection Regulation (GDPR) and our Privacy Policy available on the website.

Disputes
These GTC are governed by French law. In case of dispute, an amicable resolution will be sought first. Failing that, the competent courts will be those of the Seller’s registered office jurisdiction, unless otherwise required by mandatory legal provisions. In accordance with Articles L612-1 and L616-1 of the French Consumer Code, the Customer is informed that they may access a consumer mediation service free of charge in order to resolve a dispute with Crack In The Wall / MAKALU.

We are currently in the process of joining a mediation service. The mediator’s contact details will be published on this page as soon as possible.
